This letter serves as formal notice regarding the defective transmission sold to me by Best Quality Auto Parts and my demand for reimbursement related to the transaction.
On July 19, 2024, I received an invoice from Best Quality Auto Parts in the amount of $1,750 for a used transmission compatible with my 2003 Nissan Xterra SCSE. I promptly signed the invoice and returned it via email, authorizing payment, which was subsequently charged to my credit card. Enclosed with this notice are copies of the signed invoice and highlighted credit card statement confirming the transaction.
Approximately one week after payment, the transmission was delivered to my mechanic, located at 201 San Benito St., Ste #3, Hollister, CA 95023. The transmission was installed, but shortly thereafter, my mechanic informed me that it was malfunctioning, specifically lacking a working reverse function. Due to warranty considerations, it was inadvisable to open the transmission for further inspection. Consequently, I opted to return the defective part.
Labor and Additional Charges Incurred: In preparation for the return, my mechanic removed the transmission, incurring a labor cost of $1,013. However, when I contacted Best Quality Auto Parts regarding reimbursement for these expenses, I was informed that no reimbursement for labor charges would be provided. Furthermore, I was advised that $550 would be deducted from my refund to cover return shipping, which would reduce my reimbursement to $1,200 out of the original $1,750. Despite my attempts to discuss these terms with the sales representative and owner, my concerns were ignored, forcing me to sign under these terms to receive any reimbursement.
Request for Full Reimbursement: Given that Best Quality Auto Parts supplied a defective part, I am requesting full reimbursement for costs incurred, including the following:
• $550 return shipping fee deducted from my initial refund
• $1,013 labor cost for removal and installation of the defective transmission
The total reimbursement requested is $1,563. I request that this amount be transferred via Zelle using my contact information on file, the same method used for the prior partial reimbursement of $1,200.
Notice of Legal Action: Should payment not be received by Friday, November 15, 2024, I will pursue legal action, filing a claim on Monday, November 18, 2024, for the total amount due, as well as any additional expenses incurred, including but not limited to court costs, attorney’s fees (if applicable), and lost wages.
